Energy Performance Certificates (EPCs) are needed whenever a property is;

An EPC gives a property an energy efficiency rating from A (most efficient) to G (least efficient) and is valid for 10 years.

In April 2018, the MEES (Minimum Energy Efficiency Regulations) came into affect resulting in all properties that are sold or rented, including lease renewals requiring a minimum efficiency rating of “E”. it is the responsibility of the landlord to ensure a valid EPC is present and if the current rating is F or G improvement measures must be introduced to bring it up to standard.

You must ensure an EPC is available for potential buyers and tenants before you market your property to sell or rent.

Regulatory requirements

On 1 st April 2018, it became a criminal offence for landlords to grant new leases (including renewals and extensions of leases to existing tenants) to properties that fell below a minimum Energy Performance Certificate ‘E’ rating. The Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, across Nottingham City Council’s commercial estate; “from April 2018, private non-domestic (and domestic) landlords must ensure that properties they rent in England and Wales reach at least an Energy Performance Certificate (EPC) rating of E before granting a tenancy to new or existing tenants”.

In addition, from 1st April 2023 landlords will be in breach of the Regulations if they continue to let, under existing leases, properties that fall below the minimum ‘E’ rating.
